Personal Information is information or an opinion, whether true or not, about an individual whose identity is apparent, or can reasonably be ascertained from the information or opinion. Personal information is inherently private and sensitive.

Energy Edge recognises the importance of privacy, and is committed to protecting the privacy of personal information it collects. The Privacy Act 1988 (Cth) (Privacy Act) and the Australian Privacy Principles govern the way in which Energy Edge uses and manages personal information, subject to certain exemptions. Chapter 3 of the Information Privacy Act 2009 (Qld) (IP Act) sets out the methods by which individuals can access and amend personal information held by Energy Edge.

The objective of this privacy policy is to ensure that Energy Edge:

  • collects, uses, stores and maintains personal information in accordance with applicable legislation;
  • provides individuals with reasonable rights to access and request amendments to their personal information held by Energy Edge; and
  • maintains accurate records.

Types of personal information collected
Energy Edge may collect and hold personal information about individuals, that is, information that can identify an individual, and is relevant to providing the individual with the services they are seeking.

Purpose of collection
The personal information that Energy Edge collects and holds about individuals depends on the individual’s interaction with Energy Edge. Generally, Energy Edge will collect, use and hold personal information for the purposes of:

  • providing information and services to the individual;
  • providing information about other services that Energy Edge offers that may be of interest;
  • facilitating Energy Edge’s internal business operations, including the fulfilment of any legal requirements; and
  • analysing Energy Edge’s services and business needs with a view to developing new or improved services and business practices.

Method of collection
Personal information will generally be collected directly from an individual through the use of standard forms, over the internet, via email or through a telephone conversation. There may however, be some instances where personal information will be collected indirectly because it is unreasonable or impractical to collect personal information directly from an individual. Energy Edge will generally notify individuals about those instances in advance, or where that is not possible, as soon as reasonably practicable after the information has been collected.

Failure to provide information
If the personal information provided to Energy Edge is incomplete or inaccurate, Energy Edge may not be able to supply the relevant individual with the services they are seeking.

Internet users
Energy Edge may collect additional personal information about individuals that access Energy Edge’s website and online services, including information in the form of an IP address and domain name. Energy Edge’s website uses cookies. The main purpose of cookies is to identify users and to prepare customised web pages for them. Cookies do not identify individuals personally, but they may link back to a database record about an individual.

When users are signed in to our online services (e.g. GMAT), Energy Edge is able to identify the activity of specific users, and this usage may be linked back to a database record about that user.

Energy Edge’s website may contain links to other websites. Energy Edge is not responsible for the privacy practices of linked websites and linked websites are not subject to Energy Edge’s privacy policies and procedures.

Use and disclosure
Generally, Energy Edge will only use or disclose personal information about individuals for the purposes for which it was collected (as set out above). Energy Edge may disclose personal information about individuals:

  • To service providers, who assist Energy Edge in operating its business, and these service providers may not be required to comply with Energy Edge’s privacy policy;
  • To our employees, agents, and external advisers;
  • To Energy Edge’s related entities; and
  • As required by law.

Energy Edge does not on-sell personal information to third parties for use in marketing third party products.

Energy Edge stores personal information in different ways, including in paper and in electronic form. The security of the personal information Energy Edge holds is important to Energy Edge. Energy Edge takes all reasonable measures to ensure that personal information is stored safely to protect it from misuse, loss, unauthorised access, modification or disclosure, including electronic and physical safety security measures.

At any time, an individual may make a written access or an amendment application to the Energy Edge Privacy Officer. An individual may contact the Privacy Officer to request procedural guidance to ensure that any such application is in the required format.

The Privacy Officer will make a decision as to whether to provide access to or amend the relevant personal information and provide the individual with written notice of their decision within 25 days.

The Privacy Officer may refuse access to or amendment of records held in circumstances prescribed by the relevant laws, including where the application:

  • related to exempt information;
  • should have been made under the Right to Information Act 2009 (Qld);
  • does not comply with the application requirements; or
  • would substantially and unreasonably divert Energy Edge’s resources from the performance of business functions.

If access or amendment is denied, individuals may seek an internal or external review of the decision. An application for review must be made in writing within 20 days of receipt of notice that access or amendment is denied. An authorised person will make a decision to uphold or vary the initial decision and provide written notice to the individual of their decision within 20 days.
